Welcome to Lobsterpod! These Terms of Service (“Terms”) govern your access to and use of our managed AI agent hosting platform at lobsterpod.com (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Service, you affirm that you:

  • Are at least 18 years of age with legal capacity to enter into a binding contract.
  • Have read, understood, and agree to these Terms and our Privacy Policy.
  • Will comply with all applicable laws and regulations.

If using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Lobsterpod provides a managed hosting platform for OpenClaw, an open-source AI agent framework. The Service enables you to:

  • Deploy and manage AI agents in isolated container environments.
  • Connect agents to messaging platforms (Telegram, Discord, Slack).
  • Route AI requests through multiple AI model providers via OpenRouter/LiteLLM.
  • Monitor usage and spending with built-in budget caps.
  • Access included AI credits based on your subscription tier.

3. Account Registration and Security

To use the Service, you must create an account. You agree to provide accurate information, keep credentials confidential, and notify us immediately of unauthorized access. You are responsible for all activities under your account.

You are solely responsible for the content and behavior of AI agents you deploy, compliance with messaging platform terms, and all costs incurred under your account.

4. Subscription Plans and Pricing

4.1 Subscription Tiers

  • Starter: $39/month (includes $12/month in AI credits)
  • Pro: $99/month (includes $35/month in AI credits)
  • Business: $199/month (includes $50/month in AI credits)

All prices are in USD and exclude applicable taxes.

4.2 AI Credits and Budget Caps

  • Each plan includes monthly AI credits that reset on your billing cycle.
  • Hard spending limits prevent runaway costs. Agents stop processing at your plan's budget cap.
  • Unused credits do not roll over to the next billing period.

4.3 Billing and Payment

  • Subscriptions automatically renew monthly unless canceled.
  • Payments processed securely through Stripe.
  • Subscription fees are non-refundable except as required by law.
  • We may modify pricing with 30 days' notice. Changes apply to subsequent billing cycles.

5. Acceptable Use Policy

5.1 Prohibited Content

You agree not to use the Service to:

  • Create agents that generate illegal, harmful, abusive, or fraudulent content.
  • Violate intellectual property rights, privacy rights, or other legal rights.
  • Distribute malware or malicious code.
  • Impersonate others or harass, threaten, or intimidate others.

5.2 Prohibited Activities

  • Attempt to gain unauthorized access to the Service or other accounts.
  • Reverse engineer, decompile, or extract source code.
  • Bypass budget caps or usage limits through technical means.
  • Resell or redistribute the Service without authorization.
  • Use the Service for high-risk activities (medical diagnosis, legal advice, financial services) without appropriate safeguards.

5.3 Platform Compliance

You must comply with the terms of service of any messaging platforms you connect (Telegram, Discord, Slack) and the acceptable use policies of AI providers (OpenAI, Anthropic, etc.). Violations may result in account suspension.

6. Intellectual Property

6.1 Our Rights

The Service, including all software, designs, and trademarks, is owned by Lobsterpod. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes.

6.2 Your Content

You retain ownership of all content you create, including agent configurations and prompts. By using the Service, you grant us a limited license to host and process your content to provide the Service. We will not access your agent content except to provide support at your request, investigate suspected violations, or as required by law.

6.3 Feedback

If you provide suggestions or feedback, we may use it without obligation to you.

7. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be unavailable due to scheduled maintenance, emergency patches, third-party outages, or force majeure events.

We may modify, suspend, or discontinue features with reasonable notice. We will provide 30 days' notice for material changes that adversely affect your use.

8. Termination

8.1 By You

Cancel your subscription at any time through your dashboard. Cancellation takes effect at the end of the current billing cycle.

8.2 By Us

We may suspend or terminate your account if you violate these Terms, payments fail repeatedly, we are required by law, or your use poses a security risk.

8.3 Effect of Termination

  • Access ceases and AI agents are shut down.
  • Data retained for 90 days for recovery, then deleted.
  • You remain responsible for charges incurred before termination.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that AI agent outputs are accurate, reliable, or appropriate for any use. You are solely responsible for reviewing and validating AI outputs. Do not rely on AI agents for critical decisions without human oversight.

10. Limitation of Liability

To the maximum extent permitted by law, Lobsterpod shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or service interruptions. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Lobsterpod from any claims arising from your use of the Service, violation of these Terms, violation of third-party rights, or content generated by your AI agents.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States.

12.2 Informal Resolution

Before filing a formal dispute, contact support@lobsterpod.com to attempt informal resolution within 30 days.

12.3 Arbitration

Unresolved disputes shall be settled through binding arbitration under AAA Commercial Arbitration Rules. You agree to resolve disputes individually, not as part of a class or representative action.

13. General Provisions

  • Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement.
  • Amendments: We may modify Terms with 30 days' notice for material changes.
  • Severability: Invalid provisions are modified to the minimum extent necessary.
  • Assignment: You may not assign these Terms without our consent.
  • Force Majeure: We are not liable for failures beyond our reasonable control.
